Terms and Conditions

Introduction
Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the SSK Logistics Inc, also known as SSK Logistics Inc, website and services (the “Service”) operated by SSK Logistics Inc (“us”, “we”, or “our”). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and customers who access or use the Service. By accessing or using the Service, or by tendering any shipment to us, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
Definitions
- “Goods” or “Cargo” means any shipment, freight, parcel or property tendered to or handled by us.
- “Services” means freight forwarding, transportation, warehousing, distribution, customs brokerage and related logistics services we provide.
- “Customer”, “you” means the person or entity that requests, books or pays for the Services.
- “Carrier” means the air, ocean, road or rail operator that physically transports the Goods.
The Services
SSK Logistics Inc provides international and domestic freight forwarding and logistics services, including air freight, ocean freight, road freight, rail and intermodal transport, warehousing and distribution, and customs brokerage. We act as a freight forwarder arranging transportation with third-party carriers; we are not the operating carrier unless expressly stated in writing. All Services are subject to a separate service agreement, rate confirmation, booking, bill of lading or air waybill, which together with these Terms form the complete agreement between the parties. In the event of a conflict, the specific transport document governs the carriage it covers.
Quotes & Pricing
Quotes are estimates based on the information you provide and are valid only for the period stated. Final charges may vary due to changes in actual or chargeable weight and dimensions, fuel and security surcharges, currency adjustments, accessorial services, duties, taxes, demurrage, detention or circumstances beyond our reasonable control. Unless expressly stated otherwise, all prices are in U.S. dollars.
Payment Terms
Invoices are payable in accordance with the agreed payment terms. Charges are due without deduction, set-off or counterclaim. We reserve the right to charge interest on overdue amounts at the maximum rate permitted by law and to recover all costs of collection. Where payment is outstanding, we may withhold release of, or stop in transit, any Goods in our possession and may exercise a general and particular lien over those Goods and any related documents for all sums owed to us.
Customer Responsibilities
- Provide accurate, complete and timely shipment information and documentation.
- Ensure Goods are properly packed, marked, labeled and suitable for the transport ordered.
- Accurately describe and declare the nature, value and weight of the Goods.
- Comply with all applicable export, import, customs, sanctions and transport regulations and obtain any required licenses or permits.
- Pay all charges, duties, taxes and fees in accordance with the agreed terms.
Prohibited & Restricted Goods
You may not tender hazardous, illegal, counterfeit, perishable or otherwise restricted Goods without our prior written consent and full regulatory compliance, including proper certification and documentation for dangerous goods. We reserve the right to refuse, inspect, hold, return or dispose of any shipment that violates these Terms, applicable law, or that poses a risk to people, property or the environment, without liability to you.
Customs, Duties & Taxes
You are responsible for all duties, taxes, levies and customs charges assessed on your shipment. Where we advance such amounts on your behalf, you agree to reimburse us on demand. You are responsible for the accuracy of all customs declarations, classifications and valuations. Our licensed customs brokerage services are provided subject to applicable customs regulations and the terms of any applicable power of attorney.
Export Controls & Sanctions
You warrant that your shipments comply with all applicable export control and economic sanctions laws, including those administered by the relevant authorities of the United States. We will not knowingly handle shipments to or from embargoed destinations or restricted parties, or any shipment for which a required license has not been obtained. All export and import license requirements are the sole responsibility of the Customer, who shall indemnify us against any violation.
Cargo Insurance & Claims
Cargo insurance is not automatically included. It is available on request and is strongly recommended. Where arranged, coverage is limited to the value declared and substantiated by invoice or other proof of value. Claims for loss of, damage to, or delay of Goods must be submitted to us in writing, with supporting documentation, within the time limits required by the applicable transport convention or contract of carriage. Failure to file a timely, documented claim may bar recovery.
Limitation of Liability
Our liability for loss of or damage to Cargo is limited to the extent provided by applicable law and the governing transport conventions, including, where relevant, the Carmack Amendment, the Montreal Convention, the Hague-Visby Rules / COGSA and the CMR. Except as required by law, SSK Logistics Inc shall not be liable for any indirect, incidental, special, punitive or consequential damages, including loss of profits, revenue or business, even if advised of their possibility. Subject to any higher limit required by an applicable convention, our aggregate liability for any claim shall not exceed the amount of our service or handling fees for the shipment concerned, excluding actual transportation charges, duties and taxes.
Delays & Force Majeure
Transit times are estimates and are not guaranteed. We shall not be liable for any delay or failure to perform caused by events beyond our reasonable control, including weather, natural disasters, customs or government action, port or carrier delays, labor disputes, war, terrorism, civil unrest, epidemics or pandemics, or disruptions to transport networks.
Warehousing, Storage & Abandoned Cargo
Where we store Goods, free storage applies only for the period stated in your service agreement; thereafter storage and handling charges accrue. If Goods cannot be delivered, are refused, or remain unclaimed, we will attempt to notify you. If the Goods remain unclaimed or charges remain unpaid after the notice period, we may deem the Goods abandoned and, after giving any notice required by law, sell or dispose of them at public or private sale and apply the proceeds to amounts owed to us, without further liability to you.
Tracking Information
Tracking and status information provided through our website is offered for your convenience, may be subject to delay or revision, and does not constitute a guarantee of the location, condition or delivery time of any shipment.
Intellectual Property
All content on this website — including text, graphics, logos and software — is the property of SSK Logistics Inc or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute or create derivative works without our prior written permission.
Acceptable Use of the Website
You agree not to misuse the website, attempt to gain unauthorized access, interfere with its operation, introduce malicious code, or use it for any unlawful purpose.
SMS / 10DLC Communications
We may offer the option to receive shipment, account and onboarding updates by SMS. Message frequency varies. Message and data rates may apply. Text HELP for help. Reply STOP to cancel. Carriers are not liable for delayed or undelivered messages. Consent to receive SMS is not a condition of purchase.
Indemnification
You agree to indemnify and hold harmless SSK Logistics Inc, its officers, employees and agents from any claims, losses, fines, duties or expenses (including reasonable legal fees) arising out of your shipments, your breach of these Terms, your provision of false or incomplete information, or your violation of any law or third-party right.
Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions which by their nature should survive termination — including ownership provisions, warranty disclaimers, indemnity, payment obligations and limitations of liability — shall survive.
Governing Law & Jurisdiction
These Terms shall be governed and construed in accordance with the laws of the State of Montana and the applicable laws of the United States, without regard to conflict-of-law provisions. The courts located in Helena, MT shall have exclusive jurisdiction over any dispute. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision is held invalid or unenforceable, the remaining provisions will remain in effect.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms.
